Country Specific Course Template

This template is to be used by the lawyer or firm preparing a country-specific course.

Such instructors are welcome to include additional information, and are encouraged to make it clear what are the primary pitfalls of biotechnology patent practice in the country.   Instructors are also encouraged to include examples, images of documents, charts, diagrams and general timelines as much as possible.   Tying the content to the commercial realities in the country is also very helpful.  

Draft Outline

Government agency with authority over patents and the process

Participation in PCT and other Treaties and any distinctions

Baseline and particularities with regard to:

     Patenting method of use of compounds on humans
        (some countries consider it to be interference with practice of medicine)

     Enforcement realities

Prosecution process, appeals and timelines

What search reports are provided

Equivalent of International Preliminary Report on Patentability

Show examples of an application, granted patent etc.

Try to identify a domestic invention that was awarded a patent in biotechnology

Identify any major pharma/biotech companies in the country, 

Overall speed of the agency 

Success rates conceptually of patent challenges
