Patents Act, 1970 (as amended) is the primary law governing patents in India. It grants exclusive rights to inventors for their inventions, including life sciences-related products and processes.

While India does not have a specific law granting data exclusivity for pharmaceutical products, certain forms of exclusivity are provided through the patent system:

Market Exclusivity: In the case of regulatory approval for new drugs, the first marketing approval may have an exclusive period, preventing others from entering the market with generic versions.

Orphan Drug Exclusivity
: India does not have specific legislation for orphan drug exclusivity (exclusive rights for treatments of rare diseases), but such drugs may be granted patent protection if they meet the necessary criteria.
